Terms and Conditions — CFL Diagnostic

1. General

These Terms and Conditions (“Terms”) govern your access to and use of the website mricfl.com (the “Site”), owned and operated by CFL Diagnostic (“Practice,” “we,” “us,” “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. No Physician-Patient Relationship Created by the Site

Use of the Site, including submitting a contact or inquiry form, does not by itself create a physician-patient relationship between you and CFL Diagnostic or any of its radiologists or staff. Imaging services (MRI, X-ray, and related exams) are typically performed pursuant to an order from your referring physician. Submitting information through the Site does not guarantee that we can schedule a specific appointment, perform a particular exam, or accept a given insurance, workers’ compensation claim, or letter of protection (LOP) arrangement.

3. Medical and Imaging Disclaimer

The Site is provided for general informational purposes only. Content on the Site — including descriptions of MRI, X-ray, and other imaging procedures — is not medical advice, is not a diagnosis, and is not a substitute for evaluation by a qualified physician. Imaging results are interpreted by a radiologist and communicated to your referring physician, who is responsible for diagnosis and treatment decisions.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site’s contact form or any other feature of the Site to seek help for a medical emergency — messages submitted through the Site are not monitored in real time.

4. Consent to Be Contacted by Phone and SMS

By checking the applicable consent checkbox when submitting a form on the Site, you agree to receive calls and text messages, including those made using an automatic telephone dialing system, from CFL Diagnostic at the phone number you provide, regarding your inquiry. Message and data rates may apply. Consent is not a condition of purchasing services or receiving care. You may opt out at any time by contacting us using the information in Section 11 below.

5. No Guarantee of Outcome

We do not guarantee any particular diagnostic result, insurance approval, workers’ compensation coverage, or outcome from any exam or service referenced on the Site. Imaging results and their clinical significance are determined by a radiologist and your referring physician, not by CFL Diagnostic’s website content.

6. Intellectual Property

All content on the Site — including text, images, graphics, logos, and layout — is the property of CFL Diagnostic or is used with permission of the rights holder and is protected by applicable copyright and intellectual property laws. No content may be copied, reproduced, or distributed without the Practice’s prior written consent.

7. Third-Party Links and Widgets

The Site may contain links to, or embed content from, third-party services, including a Google reviews widget. The Practice is not responsible for the content, accuracy, or privacy practices of any third-party site or service and does not endorse them by linking to or embedding them.

8. Limitation of Liability

To the maximum extent permitted by law, CFL Diagnostic shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site. This limitation does not apply to, and nothing in these Terms limits, any liability arising from the actual provision of imaging or medical services once you are an established patient, which is governed separately by applicable Florida medical malpractice law and your care agreements with the Practice.

9. Binding Individual Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (but not any claim relating to the actual provision of imaging or medical services, which is excluded from this arbitration provision and governed separately by applicable law) shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court where eligible.

Class Action Waiver. You and the Practice agree that any arbitration or proceeding under this section shall be conducted only on an individual basis and not as a class, collective, consolidated, or representative action.

Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to the Practice at the email address in Section 11 within 30 days of the date you first accepted these Terms. Your notice must include your name, the phone number or email address associated with your inquiry, and a clear statement that you wish to opt out of arbitration.

Severability. If any part of this arbitration provision is found unenforceable, the remainder shall remain in effect, except that if the Class Action Waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than in arbitration.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute not subject to arbitration under Section 9 shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms. The effective date at the top of this page reflects the date of the most recent revision.
